Terms of Sale

1. Purpose and scope

These Terms of Sale (CGV) govern the terms of the Ziko founder offer — namely the granting of lifetime Premium access to the first 200 confirmed waitlist registrants. They complement, without replacing, the Terms of Use (CGU), which govern general use of the Service. In the event of a contradiction between the two documents on a matter relating to the founder offer, these Terms of Sale prevail.

2. Publisher identity

The Service is published by Ziko. The publisher's full identity (company name, legal form, SIRET number, registered office) is listed on the site's Legal Notice page, which these Terms of Sale reference rather than duplicate.

3. The founder offer

The first 200 people who join the Ziko waitlist and confirm their registration receive, free of charge and with no obligation to purchase or subscribe, lifetime Premium access to the Ziko application.

A place in the founder offer is granted in the chronological order of confirmed registration, within the limit of 200 places. Being granted a place involves no payment, no subscription, and no credit card.

4. Scope of the lifetime commitment

The lifetime Premium benefit is valid for the entire operating lifetime of the Service by Ziko. It corresponds to the set of Premium features available as of the founder offer date. Premium features added later may be extended to founding members at Ziko's discretion, without this constituting an additional contractual commitment.

5. Premium features and AI credits

Lifetime Premium membership unlocks all of Ziko's features. Use of artificial intelligence (AI coach, meal analysis, program generation) remains subject to a monthly AI-credit allowance, identical to that of any other Premium user. This allowance may change over time as a platform-wide policy that applies to all Premium users, and will never single out founding members specifically.

6. Changes to and discontinuation of the Service

Except as provided below, Ziko does not modify or withdraw the lifetime Premium benefit granted to founding members for as long as the Service continues to operate.

Ziko may only end founding members' lifetime Premium benefit as part of a general shutdown of the Service. In that case, Ziko commits to notifying affected users with reasonable advance notice of at least 90 days and to allowing them to export their personal data before closure.

7. Personal data

Email addresses collected through the founder waitlist are retained for 3 years from the registrant's last contact with us, in line with CNIL's NS-048 guidance, and are then deleted or anonymized.

8. No payment and right of withdrawal

The founder offer involves no payment from the registrant. The fourteen-day withdrawal right applicable to distance contracts with a monetary object therefore has no object under this offer.

The registrant may unsubscribe from the waitlist or request erasure of their data at any time by writing to support@ziko-app.com, with no justification required.

9. Language of the contract

These Terms of Sale are drafted in French, which is the sole authoritative version. The English version is provided as a courtesy translation to help non-French-speaking users. In the event of any discrepancy or contradiction between the French and English versions, the French version shall prevail.

10. Governing law and disputes

These Terms of Sale are governed by French law. In the event of a dispute relating to their interpretation or performance, the parties shall first seek an amicable resolution before pursuing any legal action.

The consumer may use a consumer mediator free of charge to seek an amicable resolution of the dispute, in accordance with Articles L.616-1 et seq. of the French Consumer Code.

Failing an amicable resolution, only the courts designated as competent under ordinary French law shall have jurisdiction over the dispute.
